By accessing or using our website, you agree to comply with and be bound by the following terms and conditions. All products (the “order”) made by “Suite Bakes” (hereafter referred to as Suite Bakes, We, Our, and Us) are subject to the following Terms and Conditions. Clients (hereafter referred to as Clients, You, and Your) must read all terms in detail before submitting an order inquiry.

ABOUT US

Suite Bakes is a home-based micro-bakery that operates an e-commerce website (“www.suitebakes.com”), and Instagram(“@suite.bakes”), to sell custom cakes and cupcakes. We do not operate out of a storefront.

INGREDIENTS

All cakes, fillings, and buttercream may contain or come into contact with wheat, dairy, nuts, eggs, or other allergens. It is the responsibility of the Client to disclose any allergies when submitting an order inquiry. To maintain the integrity of our products, we are unable to agree to ingredient substitutions.

It is the responsibility of the Client to inform their guests of all allergy information and accordingly. Suite Bakes will not be held liable for any allergic reactions.

Our products are preservative-free and made-to-order, as such, they are recommended to be eaten within 2 days for the best freshness.

ORDERS

We require at least seven (7) days notice for all orders, subject to availability. Orders are accepted on a first-come, first-serve basis.

Photos of cakes and cupcakes displayed on the order form, our website, or on Instagram at @suite.bakes are all created by us and serve as a sample of styles and designs we offer. The Client may choose an existing design, or request a custom design by providing a theme or inspiration pictures.

Any reference photo of a product produced by any other cake maker will only be used as inspiration and will not be an exact reproduction of the product. We will make every attempt to colour-match as close as possible, however, we cannot guarantee it will be an exact match due to variations in lighting or device screens.

Menu flavours may change from time to time. We can only accept order requests for flavours which are currently listed on our order form.

We specialize in buttercream cakes, as such, we reserve the right to decline order requests which include materials not offered by us. This includes, but is not limited to, fondant, plastic figurines, and fresh florals.

By selecting the option for a “Surprise Design”, you are allowing us to have full creative freedom on the design of your order. We will not accept specific themes or inspiration pictures for designs where we are granted full creative freedom. Clients may still request a personalized greeting on their cake order.

PAYMENT

All prices are listed in CAD (Canadian Dollars) and payments are only accepted through the order form on our website www.suitebakes.com. All major credit cards (Visa, Mastercard, American Express, UnionPay) are accepted and processed by “Stripe”, secure payment platform. By entering your credit card details, you are authorizing Stripe to process the payment in the amount (“Total”) indicated on your order inquiry form. Your credit card will be charged only after your order inquiry is reviewed and accepted.

REFUNDS & CANCELLATIONS

All payments are non-refundable. We will not offer refunds or exchanges for custom products that meet our quality standards.

In the event that you must cancel your order, we will arrange to reschedule the order date, subject to availability. Client must notify us of the cancellation request via E-mail (info@suitebakes.com) or Instagram (@suite.bakes) no later than 48 hours before the scheduled order pick-up time.

Should we need to cancel your order due to illness or any other unforeseen circumstance outside of our control, our best efforts will be made to reschedule your order date.

PICK-UPS AND TRANSPORTATION

Suite Bakes will send a reminder to the Client’s E-mail address submitted on their order inquiry, 48 hours before the scheduled pick-up time. The reminder email will include the pick-up address and phone number to contact. If there is an issue with receiving the reminder email, the Client must first check their Junk folder, then follow up via E-mail (info@suitebakes.com) or Instagram (@suite.bakes) to have the E-mail resent.

Once the order has left the premises, it is the Client’s responsibility to ensure it arrives to the destination safely and is stored and served as per our instructions. Suite Bakes will not be liable for any damage or accidents that occur once the order is released to the Client.

Cupcake and cake boxes must be handled with care by holding the sides with two hands. To ensure the order does not slide around in the car while driving, place boxes on a flat surface, such as the floor mats, and not on the car seat. If the temperature outside is higher than 20 degrees Celsius, the air conditioning is turned on. Leaving cupcakes or cakes in a hot car or direct heat will result in melted buttercream.

A late pick-up fee may be charged for orders that are not picked up within the designated pick-up window. We understand that circumstances may arise that could cause a delay in picking up your order. Therefore, we typically provide a grace period after the scheduled pick-up time before the late pick-up fee is applied. If you anticipate that you will be unable to pick up your order within the designated pick-up window, please notify us as soon as possible. We may be able to accommodate a revised pick-up time, depending on our availability and schedule. If we are unable to accommodate a revised pick-up time, the late pick-up fee must be paid in full by E-transfer to suite.bakes@gmail.com. This fee covers the additional costs incurred by holding the order beyond the scheduled pick-up time. Failure to pay the late pick-up fee may result in additional charges or refusal of future orders.

DELIVERY

We offer delivery within Toronto, Ontario, and the Greater Toronto Area. Delivery is subject to our availability and the delivery fee is charged at our discretion. Payments for the Delivery fee are accepted via Email Money Transfer (E-transfer) as indicated in the E-mail instructions sent to the Client.

A delivery date and time will be agreed by both parties, and if the Client is not at location at the agreed time and date, the order will be transported back to the Suite Bakes premises and it will be the Client’s responsibility to collect the order. The Delivery fee is non-refundable.

Once the order is safely delivered to the Client, it is the Client’s responsibility to store and serve as per our instructions.

STORAGE AND SERVING

Cakes should be stored and served at room temperature and do not need to be refrigerated, if serving on the same day. If you intend to serve the cake on a future date, refrigerate the cake in-box until the event. Remove the cake from the fridge and let it sit at room temperature for about two (2) hours before serving, to allow the buttercream to soften up again. 

Cupcakes should be stored and served at room temperature and do not need to be refrigerated, regardless of whether it is being served on the same or future date. Refrigerating the cupcakes will result in changes to the original texture and dryness that cannot be reversed.

If serving or displaying outdoors, do not leave in direct heat or sunlight. High temperatures will cause the buttercream to melt.

Cakes and cupcakes are recommended to be eaten within two (2) days for the best freshness. Leftovers should be transferred to an airtight container to extend product-life and preserve moisture.

PUBLICATION

We reserve the right to use any image of a Product made by us for publication at a later date.

PRIVACY

The Client’s contact information, such as name, E-mail, and phone number, are solely used for the purpose of confirmation and communication related to the submission, creation, and pick-up or delivery of the order.

COPYRIGHT INFRINGEMENT

All content on this website, including but not limited to text, graphics, logos, images, videos, and software, is the property of Suite Bakes or its licensors and is protected by copyright laws. Any unauthorized use, reproduction, distribution, or modification of this content is strictly prohibited and may result in legal action.

USER-GENERATED CONTENT

Users may submit or upload content to our website, such as comments, reviews, testimonials, or reference pictures. By doing so, you grant Suite Bakes a perpetual, irrevocable, worldwide, royalty-free license to use, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any form, media, or technology now known or hereafter developed. You also warrant that you have the right to grant this license and that your content does not infringe on the rights of any third party.

TERMINATION OF ACCESS

e reserve the right to terminate or suspend access to our website for anyone who violates these terms and conditions or engages in copyright infringement or other unlawful activities.

CHANGES TO THESE TERMS

We reserve the right to revise these present Terms & Conditions at any time by updating this site. Please ensure that you check this page from time to time to be aware of any changes. Please ensure that you save a copy of the terms applicable at the time of your order, as we will not retain copies for Clients. By continuing to use our website after any such changes, you agree to be bound by the revised terms and conditions.

GOVERNING LAW

These terms and conditions shall be governed by and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
